These Terms of Service (“Terms”) are a binding agreement between you and Odyssa (“we,” “us,” “our”), the operator of the Odyssa website and service (the “Service”), available at https://odyssa.me. By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 16 years old to use the Service. If you are under 18, you may use the Service only with the consent and supervision of a parent or legal guardian. We do not knowingly allow children under 16 to create an account or provide personal data. The Service is intended for a global audience and is not directed at users in Vietnam.
The Service is a personal travel map. You can:

You are responsible for providing accurate information, keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.
Certain features — including additional 3D map themes, uploading photos and videos, and downloading your 3D globe video — require a paid Subscription.
You retain ownership of your User Content. By uploading or sharing User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt (for formatting/display), and display that content as necessary to operate, provide, and promote the Service. This license ends when you delete the content or your account, except for content others have already accessed via a share link, and for reasonable backup copies.
You represent that you own or have all rights necessary to your User Content and that it does not violate any law or third-party right. Your use of the Service must comply with our User-Generated Content Rules.
If you share a link to your 3D globe, anyone with the link may view the content you have chosen to include. You are solely responsible for what you share and with whom. We may disable or remove share links that violate these Terms or applicable law.
The Service, including the software, 3D globe, map themes, Editorial Content, logos, and design, is owned by or licensed to us and protected by intellectual property laws, including the laws of Vietnam. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, scrape, or create derivative works from the Service or Editorial Content without our written permission.
You agree not to misuse the Service, including by: violating any law; infringing others’ rights; uploading prohibited content (see the UGC Rules); scraping or harvesting data without permission; interfering with, overloading, or attacking the Service; or impersonating others or misusing accounts.
The Service relies on third parties (the Payment Provider, hosting/CDN providers, and map-data providers). We are not responsible for third-party services, and your use of them may be subject to their own terms.
The 3D globe is a stylized, low-detail illustration provided for personal and illustrative purposes. It may omit small islands and show approximate borders, and it is not an authoritative map. Do not rely on it for navigation or for legal or geographic accuracy.
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
We respond to copyright complaints under our DMCA / Copyright Policy.
The Service and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including accuracy, completeness, fitness for a particular purpose, or non-infringement. Travel information is for reference only; you use it at your own risk. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months before the claim.
You agree to indemnify and hold us harmless from any claims, losses, and costs (including reasonable legal fees) arising from your User Content, your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
We may suspend or terminate your access, with or without notice, if you breach these Terms or applicable law. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
We may update these Terms from time to time. We will post the updated version with a new effective date and, for material changes, provide reasonable notice. Your continued use after changes take effect constitutes acceptance.
These Terms are governed by and construed in accordance with the laws of Vietnam, without regard to conflict-of-laws rules. Any dispute shall first be addressed through good-faith negotiation. If unresolved, it shall be submitted to the competent courts of Vietnam.
If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them. These Terms and the policies referenced here form the entire agreement between you and us. We are not liable for delays or failures caused by events beyond our reasonable control.
